Be Entertained Agency

1. Introduction
These Terms and Conditions ("Terms") set out the agreement between Be Entertained Agency ("the Agency") and its clients ("the Client"). By booking services with the Agency, the Client agrees to abide by these Terms.

2. Services
The Agency provides entertainment services, including but not limited to live performances, event hosting, and talent bookings. The details of each engagement, including date, time, location, and specific requirements, will be outlined in a separate agreement or invoice.

3. Booking and Payment

  • A booking is confirmed once a contract is signed and/or a deposit is received.

  • Full payment must be made at least 5 days before the event unless otherwise agreed.

4. Cancellation Policy

  • Cancellations must be made in writing and sent to holly@beentertained.co.uk

  • Cancellations made at least two weeks (14 days) before the event can be cancelled without incurring additional charges; however, the deposit is non-refundable.

  • Cancellations made less than two weeks (14 days) before the event will be charged the full agreed-upon amount.

  • In the event of force majeure (e.g., natural disasters, government restrictions), cancellations may be considered without penalty at the Agency’s discretion.

5. Client Responsibilities

  • The Client must provide accurate information regarding the event.

  • The Client must ensure that the venue meets the technical and logistical requirements for the performance.

  • The Client is responsible for obtaining any necessary permits or licenses.

6. Performer Substitutions
In the event of unforeseen circumstances preventing a booked performer from attending, the Agency will make reasonable efforts to provide a suitable replacement. If no replacement is available, the Client will receive a full refund.

7. Employee Safety and Well-being

  • The Agency prioritises the safety and well-being of its employees and performers.

  • If at any point an employee or performer feels unsafe or is placed in a difficult position, they have the right to leave the event immediately without penalty.

  • The Client must ensure a safe and respectful environment for all Agency personnel. Any behaviour deemed threatening, abusive, or inappropriate may result in the termination of services without refund.

  • Performers must have a safe, private, and respectful place to change. If such a space is not provided or was not disclosed prior to the event, the performer has the right to leave without penalty.

8. Performer Exclusivity

  • The Client agrees not to directly contact or attempt to book any performer provided by the Agency for any future engagements without prior approval from the Agency.

  • All bookings and future work for the performer must go through Be Entertained Agency.

  • Any violation of this clause may result in legal action and financial penalties as determined by the Agency.

9. Weather-Related Cancellations

  • In the event of bad weather preventing the event from going ahead, the Client will be charged the full agreed-upon amount unless the event was cancelled within the cancellation period outlined in Section 4.

  • The Agency will work with the Client to provide a backup plan agreed upon before the event. If no appropriate solution can be found, the full amount will still be due as per the original agreement.

10. Ownership of Photos and Videos

  • The Agency reserves the right to use such photos or videos for promotional, marketing, or other purposes as they deem appropriate.

11. Liability and Indemnity

  • The Agency is not liable for any loss, damage, or injury arising from the services provided unless due to gross negligence.

  • The Client agrees to indemnify the Agency against any claims arising from their event, including property damage and third-party claims.

12. Force Majeure
The Agency shall not be liable for failure to fulfill obligations due to unforeseen events beyond their control, including but not limited to natural disasters, government restrictions, or illness.

13. Confidentiality
Both parties agree to keep all confidential information regarding the booking private unless disclosure is required by law.

14. Governing Law
These Terms are governed by the laws of England, and any disputes shall be resolved in the courts of England.
